Female patients suffering from brain injuries sexually assaulted by nursing assistant; accusations dismissed as "delusional" by hospital staff

The Los Angeles Times details a lawsuit filed by two women who were sexually assaulted by a nursing assistant while in the hospital recovering from brain trauma. Upon reporting the incidents to hospital staff, the women were told that they were "delusional" due to cognitive issues.

The incidents occurred at a Santa Barbara rehabilitation hospital in 2010 and 2011. Both women reported being sexually assaulted in the shower by the same male hospital aide. The alleged perpetrator of the attacks is still a licensed nursing assistant, but no longer works at the hospital in question. Records indicate that the hospital neglected to report the attacks to the police despite assurances to the victims that they would do so.

Both women have filed a joint lawsuit against the nursing assistant, the hospital and its parent corporation, seeking damages for sexual battery, infliction of emotional distress, fraud, abuse, negligence and premises liability.
